The virtual display is a computer rendition of the homes and the size, shape, building materials, colors and other features of the homes may differ from the actual as-built condition of the property. Square footage numbers are approximate and may vary depending on the standard measurement used. In addition, square footage and design may change from the original conceptual design throughout the actual construction process. References to home prices that may appear in the Web pages refer to the base house and do not include any optional features. Prices are subject to change at any time and without notice. Photos or drawings of homes may show upgraded landscaping and may not represent the lowest-priced homes in the community. Olson expressly reserves the right to make changes to its home designs, prices, available options and other features, and to build more or fewer homes than currently planned.

4. Special Disclaimer Regarding Business Relationship.

This is to notify you that Olson has a business relationship with Hayward Financial, Inc., one of its financial partners providing available financing services to Olson customers. Specifically, Olson has an eighty percent (80%) ownership interest in Hayward Financial, Inc. and Steven Hayward is President of Hayward Financial, Inc. and President of Hayward Capital, Inc. Hayward Capital, Inc. owns a twenty percent (20%) interest in Hayward Financial, Inc. and Steven Hayward owns all of the shares of stock in Hayward Capital, Inc. Because of these relationships, a referral by Olson of your business to Hayward Financial, Inc. may provide Olson with a financial or other benefit.

In some cases, Sea Country Escrow Company, Inc. ("Sea Country Escrow") may be named as the Escrow Holder in Olson transactions. Steven Hayward is President of Sea County Escrow. You are not required to use the services of Sea Country Escrow to provide the escrow services in any transaction with Olson. If you wish to use another escrow company, you should advise Olson's sales personnel and another escrow company will be selected by Olson.

If you elect to purchase a home from Olson, Hayward Financial, Inc. may be providing loan and/or loan related services in connection with your purchase of property from Olson. Notwithstanding any other provision in any contract you enter into with Olson, you understand that Olson will not pay any escrow fee to Sea Country Escrow in connection with the escrow of your property. Hayward Financial, Inc. is in the business of providing loan brokerage and loan services. Notwithstanding the business relationship between Olson and Hayward Financial, Inc., Olson has absolutely no obligation whatsoever to investigate any loan programs, related financial services, products or activities or other services provided or recommended by Hayward Financial, Inc. or any obligation to use Hayward Financial, Inc. in any capacity as a condition to the purchase of property. Subject to the terms of the contract you may enter into with Olson, you are free to obtain the services provided by Hayward Financial, Inc. from any other lender, loan brokerage, banking business or settlement service that offers such services. You understand, however that your lender may require you to use a particular attorney, credit reporting agency or real estate appraiser in connection with your transaction to represent the lender's interest. If you do not select otherwise, your mortgage broker or lender in connection with your purchase of property from Olson may be Hayward Financial, Inc. You may obtain an estimate of the fees or range of fees charged by Hayward Financial, Inc. for its services directly from Hayward Financial, Inc. at 31878 del Obispo, Suite 112, San Juan Capistrano, California 92675-9868.

5. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, OLSON SHALL NOT BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE THE CONTENT IN THIS SITE, EVEN IF OLSON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING LIABILITY ASSOCIATED WITH ANY COMPUTER VIRUS WHICH MAY INFECT YOUR COMPUTER SYSTEM.
